Terms of the order and purchase of the doll

 

By this public offer, the Author, whose name and details are indicated in the "Author's Details" section, proposes to conclude a contract on the following terms with any individual who has withdrawn, hereinafter referred to as the client (customer).

Terms and definition

A client (customer) is an individual who orders/purchases a ready–made doll exclusively for personal, family, household and other needs that are not defined by the boundaries of entrepreneurial activity.

1. The relations between the author and the buyer of the doll are subject to the norms of the civil legislation of the Russian Federation, namely, the terms of the contract (Article 702 of the Civil Code of the Russian Federation), according to which the author (contractor) is obliged to make the doll by order of the client, and the client (customer) is obliged to pay for the work and accept the doll.

When ordering a doll, the author and the client agree on all the essential conditions and the client fills out the order form, according to which the author makes the doll.

 

2. Payment.

When placing an order, the client makes a deposit, which the author distributes for the necessary materials and other costs associated with the order at his discretion. In accordance with Article 381 of the Civil Code of the Russian Federation, upon termination of the contract (refusal of the order) at the initiative of the client, the deposit remains with the author and is not refundable.

The remaining part of the doll's price is paid by the client within three calendar days from the date of receipt of the notification from the author that the doll is ready.

Payment is made by the client by transferring funds to the author's bank details, which the latter provides in an email when placing the order.

 

3. Claims.

After receiving the doll, the client is obliged to carefully examine and accept the doll within three calendar days, and if significant defects are found, immediately inform the author and send photos of the defects.

The significant disadvantages of the doll include:

- chips on the parts, violation of the integrity of the parts;

- no details specified in the order;

- non-compliance of parts with the order;

- the color of the doll's body that does not match the order (meaning a different color of the skin tone palette);

- bright spots and uneven color of the doll's body;

- distortion of the parts;

- loose fit of the doll parts to each other, gaps of more than 1 mm between the front panels and the main part of the head

 

In case of detection of significant shortcomings of the doll, the author must eliminate them at his own expense, and if it is impossible to eliminate the shortcomings, make a new doll or return the money paid for the doll to the client.

 

The significant disadvantages of the doll do NOT include:

- the difference between the color of the doll's body and the color of the same skin tone in the photos (colors can be perceived differently on the screens of digital devices, depending on the color rendering, as well as the lighting conditions when shooting);

- small spots and small bubbles;

- detaching the magnet;

- removal of the glued material in the joint receiver;

 

4. Service life.

In conditions of careful handling, the life of the doll is not limited. The textile elastic band on which the doll parts are stretched is a consumable material, and over time it can stretch and lose elasticity. The client can send the doll to the author for re-drawing at their own expense or re-draw the doll themselves (following the author's instructions).

 

5. International contract litigation.

In accordance with Article 1211 of the Civil Code of the Russian Federation, the law of the seller's (author's) country will apply to relations that have arisen between customers who are not citizens of the Russian Federation and the author.

 

6. Delivery.

All risks associated with the postal delivery of the doll are borne by the author. When sending the doll outside the Russian Federation, the author specifies the full value of the doll in the customs declaration. This is his protection in case the post office loses the doll and will have to compensate the author for the losses. In this case, the author makes a new doll for the client at his own expense, and he himself bears the burden of proceedings with the post office regarding the loss of the doll and compensation for damages.

 

If there are restrictions on the duty-free import of goods in the client's country, the client pays for all additional costs associated with the customs clearance of the doll. If the client asks the author not to indicate the full value of the doll in the customs declaration, then he himself bears the risks of losing the doll by mail.

The author is not responsible for the terms of postal delivery. In case of loss of the parcel, the author is obliged to make and send a new doll to the client at his own expense. A parcel with a doll is considered lost only if the post office has provided the author with an official letter stating that the parcel is lost. The legislation does not regulate the control terms of postal shipments for international traffic, so the delivery time of the doll can be from several days to several months. During the delivery period, the client cannot make any claims to the author about the delay in delivery.

 

7. Additional services

 

The painting of the body is made by the author at the request of the client and is an additional service. Blushing and make-up of the doll is performed by the author in a mixed technique using acrylic, oil, watercolor paints, soft and hard pastels, and is covered with a persistent acrylic varnish.

The author DOES NOT MAKE COPIES OF REFERENCES, the client can send the author photos with examples of makeup or doll painting, the author accepts the client's wishes (lip color, nails, etc.), but makes makeup and painting to his taste.

The paint coating of the doll is protective only against the erasure of paint from the doll's body. The painted surface of the doll's body should not be subjected to friction and interaction with aggressive substances, such as acetone, liquids containing acetone, alcohols and other solvents. The painted doll can be wiped with a cotton sponge moistened with clean water.

The tips of the fingers of the hands and feet, as well as the nipples of the doll, are the thinnest and most vulnerable places where damage to the painted coating occurs first. To avoid this, it is necessary to avoid rubbing the doll's limbs on accessories, shoes, etc. The painted doll must be placed on a soft surface, from interaction with a hard surface at the points of friction may also appear rubbed.

Upon receipt of the doll, the customer must carefully inspect the doll and immediately inform the author if significant defects are found.

 

Significant disadvantages of body painting include:

- swelling of the varnish coating, the departure of the paint layer.

 

Significant disadvantages do not include:

- paint scuffs formed due to careless operation of the doll, contact of painted parts with hard surfaces and aggressive chemicals.

 

All claims for the painting of the doll are accepted within three calendar days after its receipt. When submitting a claim to the author, the client must provide clear photos or videos of places with damage to the paint coating.

 

The service life of the painted surface is not limited and depends only on the conditions of use.

 

Wigs are made by the author at the request of the client and are an additional service. The color, material, length and shape of the hairstyle are discussed with the client when ordering.

Wigs painted in bright colors can stain objects in contact with them when wet. The hard cap of the wig is made of polymer and smeared on the inside with a special composition for soft contact with the doll's head. At first, when combing a wig, a small amount of hair may fall out, this is considered the norm.

The service life of the wigs is not limited and depends only on the conditions of use.

 

Accessories for dolls and mannequins are made by printing on a 3D printer. Photopolymer is not as strong as polyurethane, so accessories and thin parts of the mannequin are afraid of falling, rough impact, bending and friction. The thinnest places on accessories, such as the ribbon loops on shoes, are the most vulnerable and require very careful handling. The photopolymer is afraid of direct sunlight, light details can turn yellow when interacting with ultraviolet light. Do not leave the accessories and the mannequin in the open sun.

The mannequin is collapsible and consists of separate parts that can be used either individually or connected together into a whole body. The parts of the dummy are attached to each other with the help of chopsticks with a magnet and holes in which the magnet is also located.

 

Acceptance by the client of all additional services, accessories, mannequin, wigs, etc. is carried out within three calendar days from the date of receipt. In case of detection of significant defects, breakage or damage to something, the client is obliged to immediately inform the author and send photos. In this case, the author must eliminate the shortcomings or replace the product at his own expense.

 

8. Rules of conduct of the client in the presence of claims.

If significant defects of the doll and related products are found, the client is obliged to inform the author about these defects within three calendar days from the moment of receipt of the doll by writing a letter to the author's email address specified on the website, and attach photos or videos of the defects.

In the content of the claim, the client must list the type of deficiencies. The client should NOT describe their emotions, arguments, lamentations, stories and other unnecessary information. This only takes up the author's time and does not contribute to a quick solution of the disputed situation.

By ordering a doll, you confirm that you have read the description of the doll and agree to these terms of purchase.
